The cause:- undefinite but may be:-

- Impaired respiratory reflexes.
- Diet : Improper diet causing nutritional deficiences or hypernatremia.
- Sensetivity to milk proteins.
- Cardiac conduction disorders.
- Co or Co2 poisoning.
- Overlying in the early life.
- Thermal: Hyper or hypothermia.
*Features of the syndrome:
– Age: () 2weeks and 2 years with a peak 2-3 months of life.
– Sex : males more than females.
– Social level: low socioeconomic level more than high socioeconomic level.
– Whether: cold winter more than hot summer.
– Twins more than single babies due to:
- increase icidence prematurity.
- low birth weight.

JUDICIAL SYSTEM OF NEPAL
There are different courts to deal with civil and criminal cases in different parts of Nepal.
- Supreme court- one
- Zonal courts(kshetriya court) – 5 in no:
- Divisional courts- 15in no:
(there are 14 divisions in Nepal. each division has one appellant court and sagarmatha division has 2 courts-Rajbiraj and Okhaldunga)=total 15 courts.
- District courts- 75 in no:
each district one court . these are courts of first instance.
- Special courts-at times as per need it is formed. eg: Bagmati special court.
- Quasi judicial courts-
a)Nagar panchayat,village panchayat,district panchayatà Panchayat sanity
b)Land development authority
c)Income tax and other tax authority.
d)Forest development officer, etc
Supreme court judges are 5 in no: and their age of retirement is 65 years.
Appellant court judges retirement age is 63 years.

NO DEATH SENTENCE IS GIVEN LEGALLY IN NEPAL.

- should not be given by the common witness, may be given by the expert witness to give special knowledge to court to elicit truth.
DYING DECLARATION
It is a statement, written or verbal, made by a dying person about the cause and circumstances relating to his/her impending death.
- This is accepted in court of law as legal evidence after the death of the person who has made it. It is assumed that a dying person will speak truth only during last moment of his life when he/ she apprehends imminent death.
- It is not valid anymore if the declarant survives.
- It is not invalid if the person survives for some days more after making the declaration.
- Thereshould be material corroboration for a dying declaration before it can be used as an evidence.It must be tested in the light of surrounding circumstances in which the dying declaration has been made.
- The persons oath is not reqd for the D.D
- The dying declaration is made before any magistrate of executive or JMFC rank.In his absence the registered medical practitioner can only record it.
- Police officer of no rank or I.O. should be present and is not authorized legally to record it.
PROCEDURES AND RULES OF RECORDING OF DYING DECLARATION:
- As soon as a person who is going to die or likely to die of any form of criminal act or cause is brought to hospital, the MO should at once send for a magistrate through police for recording the DD.
If he is not available or the person,s condition is so grave that death or unconsciousness may supervene before arrival of the magistrate then the doctor should record it in presence of 2-3 witnesses.
- It should be recorded in bedside of the person at the earliest but he should not be made aware that he is dying.
- Prior to taking down the DD the doctor should assess the persons compos mentis ie, his mental condition is sound and normal to understand the meaning and implication oh his statement.
- It is only use in case of trial of murder cases.
- The recordings should be done in full details in his own wordings.
- If the statement is not continuous one and certain points needs to be clarified , questions may be asked but no leading questions should be put. The exact question and answer should be noted down in verbation.
- The statement only is recorded but no opinion of the fact should be noted.
- No undue influence , prompting , suggestions etc allowed.
- After the statement is recorded , it should be read before the person and his signature is taken on it.
- If he becomes unconscious in the middle of recording before the statement completes , it should be stopped there and the doctor should sign over it in presence of the witness along with the signature of the witness taken.
- The declaration should be sealed packed and immediately forwarded in a sealed cover direct to the respective magistrate concerned.
LEGAL VALUE:
- It can be used as an evidence in the trial of homicide.
- It can be used as subject matter of inquiry.
DYING DEPOSITION:
It is a statement of dying person before a magistrate , the accused and his lawyer , on oath stating the condition or circumstances of his dying condition.
It is like a magistrate court at the bedside of a dying man. The accused is allowed to cross examine him.
RULES:
- COMPOS MENTIS and physical fitness certified by MO.
- Statement given by the person on oath.
- Magistrate only can record it.
- Cross examination is allowed.
- The accused and his lawyer are asked to be present during it.
MEDICOLEGAL IMPORTANCE:
1)It has more value than Dying Declaration.

NEPAL MEDICAL COUNCIL: INTRODUCTION AND ITS CURRENT LEGAL AND INSTITUTIONALY CAPABILITY.
NMC:HISTORICAL ASPECTS:
- Nepal Medical Association (NMA) was established on the 20th Falgun 2007 BS (in march 1950 A.D) and since then it was advocating for the establishment of Nepal Medical Council.
- First “All Nepal Medical Conference” was held in 1963, where resolution was adopted to request HMG to legislate Medical Council Act .
- Nepal Medical Council Act was published in Nepal Gazettte of 16th falgun 2020BS.
- The NMC Act has been amended thrice so far:
1st Amendment 2044 BS(1987 AD)
2nd Amendment 2047BS(1990 AD)
3rd Amendment 2055BS(1998 AD)
PREAMBLE– Having considered it desirable to specify the qualification of doctors in modern medicine and for the registration of qualified doctors, or scientific use of modern medicine throughout the kingdom of Nepal, this law has been enacted by His Majesty King Mahendra Bir Shadev with the advice and consultance of Rastriya Panchayat.
- NMC is an autonomous body but overall authority body but overall authorityship will lie under the HMG.
ORGANISATION OF THE COUNCIL:
Present Organization of NMC has the following members as per article 3 of this act.
Chairman 1 nominated by HMG
Vice Chairman 1 Elected amongst the NMC members
Members 19 total, ie,
- Elected my NMA
- Nominated by NMC
3 Nominated by HMG
2 Ex officio (Dean, IOM Director, and President NMA on rotation basis.)
8 Elected by NMC
4 Persons appointed by HMG as per advice of NMC-1 each from
preclinical,
paraclinical,
dental union of doctors,
representative of consumers forum.
They may be elected, nominated or be an Exofficio.
FUNCTIONS OF NMC:
- Registration of medical doctors
- to ensure the standard of medical education in the country.
- to take disciplinary actions against its members if necessary.
- to protect the health of the public by publishing a register of registered medical doctors and thus enabling them to distinguish qualified from non qualified practitioners.
- to take action against persons practicing medicines without qualifications and / or without registration in NMC.
TYPES OF REGISTRATION:
- Provisional registration
- Permanent registration
- Temporary registration
- Specialist registration
PROVISIONAL REGISTRATION
- For the doctors who have passed final MBBS or equivalent examination but have not undergone Internship Training.
Requirements:
- Duly filled- up application form.
- Attested copies of MBBS, ISc,/10+2 (or certificate level in medical science from Tribhuvan University) and S.L.C certificates
- Attested copy of citizenship certificate (in case of Nepalese citizen)
- 3 passport size black and white photos taken within last 6 months.
- Promise made to abide by the rules and regulations of NMC and its Code of Conduct.
- Rs 50.00 as registration fee
PERMANENT REGISTRATION
- For Nepalese doctors who have had undergone successful internship training.
Requirements
- Duly filled- up application form.
- Attested copies of MBBS, ISc,/10+2 (or certificate level in medical science from Tribhuvan University) and S.L.C certificates
- Attested copy of Internship certificate.
- Attested copy of citizenship certificate (in case of Nepalese citizen)
- 3 passport size black and white photos taken within last 6 months.
- Promise made to abide by the rules and regulations of NMC and its Code of Conduct.
- Attested copy of certificate of registration in other medical councils , if yes.
- Rs 100.00 as Registration Fee(Rs 50.00 only for those doctors who have had Provisional Registration.)
TEMPORARY REGISTRATION
- Only for foreign doctors wishing to work in Nepal.
Requirements:
- Duly filled- up application form.
- attested copies of MBBS or equivalent degree and other qualifications.
- Good standing certificate from the respective Medical Council.
- Attested copy of certificate of registration in other medical councils , if yes.
- Recommendation letter from the local employer , if applicable.
- Letter stating clearly:

- 3 passport size black and white photos taken within last 6 months.

- Temporary registration is valid to work only in a specified institution/place in the country.
- Temporary registration can be given for a maximum period of 2 years at a time and it can be renewed , if necessary.
SPECIALIST REGISTRATION
- For doctors who have specialist qualification plus permanent NMC registration.
Requirements
- Duly filled up application form.
- Attested copy of permanent NMC registration certificate
- Attested copy of specialist qualification
- Attested copy of certificate of registration in other medical councils , if yes.
- passport size black and white photos taken within last 6 months.
- Promise made to abide by the rules and regulations of NMC and its Code of Conduct.
- REGISTRATION FEES:Rs 200.00 in the beginning.

- Rs 100.00 as annual fee( to be paid Within a month of next year)
- Rs 10.00 per month as late fee for first 6 months.
- Rs 15.00 per month as late fee for another 6 months.
- Cancellation of registration , if the annual fee is not paid in the above mentioned time.
- Permanent specialist registration charge Rs 2,000.00
NAMES CAN BE REMOVED FROM THE REGISTER ON THE FOLLOWING GROUNDS.
- Found guilty of criminal offenses by the court of
- Found indulged in malpractice and unethical conduct( this must be passed by the 2/3rds majority of the council members)
- Names registered by mistakes or by deception
- When found unfit to practice medicine because of unsoundness of mind.
- Application requesting to remove ones own name from the register.
PENALTY FOR PRACTISING WITHOUT REGISTRATION
- No person can practice , either directly or indirectly , without being registered in NMC
- Violation of this rule may result in :

Cognigible offence- in which police can arrest the offender without warrant issued by court under any provision of law.
Eg: rape ,murder,etc
Non cognigible offence– where police cannot arrest without warrant under any provision of law even without order of respective magistrate.
Eg: assault, drunken nuisance, stealing.
SUMMON- is a command or directory issued by a court generally to an accused or to a witness whose attendance is reqd in the court. It is served in duplicate with signature and seal of the presiding officer of the court.
SUBPOENA- (SUB=under, POENA=penalty)
It is a document, command, writ or directory order issued in duplicate by the court with proper seal and signature compelling the presence of witness in the court in certain date and time for giving evidence in a particular case matter with a warning not to be absentwithout prior permission from the court.
It is also served to produce documents in his possession before the court .
Medico legal importance- In civil cases non compliance is liable to action of damage.
In criminal cases non compliance may lead to issue of warrant of arrestto compel his attendance and subsequent punishment of fine and imprisonment,unless satisfactory cause is putforth.
If 2 summons issued from diff courts for the same day
à criminal cases should be attended with priority to civil case
àin criminal cases higher court should be given preference than lower court
and other court should be informed about it.
àin cases of same rank courts and same type of cases summon received earlier should be given priority.
CONDUCT MONEY – It is a fees to to be offered to a witness in civil case at the time of serving the summon towards his expenses to attend the court.
In civil cases- the party pays it.
In criminal cases- the party or court (state) will pay it
M.O-may demand it in civil case and may avoid attending court if not received it.
I n criminal cases if it is not paid then also he is duty bound to attend to give evidence. He cannot demand it.
WITNESS- who gives evidence in court regarding facts in relation to the concerned case.
Types of witnesses are
- Common witness- who states the facts observed , heard or perceived by him related to case matter.
- Expert witness-who by his professional knowledge and skill is capable of giving opinion or derive inference from the facts observed by him or by others.
MEDICAL PRACTITIONER-common witness and expert witness.
- Hostile witness- who alters his statement given previously or alters the fact with some motive.
- Skilled witness- (scientific witness) who due to his specialized knowledge of technical subject gives evidence with first hand knowledge of the case.
EVIDENCE-It is something as proof towards a case given in the court of law.

PERJURY- A witness in a judicial proceeding after taking oath , if knowingly or willfully gives false evidence or fabricate or omits part of evidence with an intention that such evidence could be utilized in the proceedings of the case is known as perjury
It is a cognigible offence and punishable for upto 3 months imprisonment or fine upto Rs 500/- or both.
